Once an Employer has knowledge of a human rights abuse they must at that time take all appropriate action('s) to ensure that the abuse is dealt with and that it does not continue. This means that an actual complaint is not required to be made by the victim of abuse before action is to be taken but any knowledge from any source.

That under the Ontario Human Rights Act there must be a proven history of repeat abuse.

It is the employees responsibility to inform the person that their actions are not proper. ( The victim should make note of this at the time)

It is the perception of the victim of abuse that is considered and not what other’s may perceive that is important.

All supervisors and managers are by law an extension of the employer in matters concerning the Human Rights Act. This means the employer is also held accountable.
